Terms and Conditions for the Purchase of Stallion Seasons From ITOBA

(Applicable to seasons purchased for the 2008 breeding season)

 

By placing a bid either online or by phone, you agree to the following terms and conditions:

 

 

 

The following terms and conditions apply to the purchase of any Stallion Season purchased from ITOBA for the 2008 breeding season. Please read all terms and conditions prior to bidding on a season.  All bidders are responsible for understanding these terms and conditions.  If you do not understand these terms adn conditions, it is your responsibility to clarify any questions or concerns with an ITOBA representative prior to biddingon a season.  Contact ITOBA at:  info@itoba.com  or 800-450-9895.

 

1.   Do not make a bid that you are unwilling to honor.  All bids are considered binding contracts, and if you place the winning bid, you are responsible for paying that amount to ITOBA immediately upon notice that your bid has been accepted.

 

2.   If you are the winning bidder and you do not pay the amount owed to ITOBA in full immediately following notice that your bid has been accepted, you will be ineligible to participate in any ITOBA sponsored events in the future, including future stallion season and live horse auctions, until the balance due for the season is paid in full.

 

3.   If you currently have outstanding invoices with ITOBA, you are ineligible to participate in this or any future ITOBA sponsored events until your account has been settled.

 

4.   If you are a non-ITOBA member and your bid is accepted for one or more seasons, there will be a surcharge of $30.00 added to your invoice.  This surcharge will include an ITOBA membership, good through the end of 2008.  Additional surcharges will not be charged for multiple winning bids.  This surcharge does not apply to ITOBA members.

 

5.   A Live Foal Guarantee (LFG) means that if your mare does not produce a live foal from the purchased season in 2009, you will be entitled to return your mare (or a substitute mare which must be approved by the stallion season donator if your mare is unable to be bred) in 2009 to be rebred with no additional stud fees due. Your bid amount is still due immediately upon notice that your bid has been accepted, whether the season is LFG or NG.

6.   If the stallion you purchase a season to is unable to be bred to your mare due to death, pensioning, or relocation, you will be issued a credit of the full bid amount to be used toward the purchase of any still available stallion season or, if you prefer, to be used in the 2009 stallion seasons auction.

 

7.   All winning bidders of seasons to stallions standing in Kentucky will be charged Kentucky Sales Tax at the rate of 6% of the final bid.  This sales tax applies to every season sold to stallions standing in the State of Kentucky, and must be remitted to ITOBA with the payment of the winning bid amount.
